Rights and obligations – lodging agreement of the Deutsche Hotel- und Gaststättenverband (DEHOGA)
Please adhere to your rights and obligations when booking a holiday flat:
As usual in business, legal arrangements have to be made when booking a holiday flat. A reservation made by the guest and an acceptance by the host is the basis of a contractual relationship, the lodging agreement.
Like all contracts, the lodging agreement can only be withdrawn from by mutual consent of the two parties.
In particular the lodging agreement contains the following rights and obligations:
- The lodging agreement is concluded as soon as the holiday flat is booked and confirmed or, if confirmation is no longer possible due to time constraints, as soon as it is made available.
- The completion of the lodging agreement obligates the contract partners to the fulfilment of the contract regardless the contract period.
- The landlord (hotelier) is obliged to offer the guest compensation if the reserved flat is not available.
- In case of non fulfilment of the contractual obligations, the guest is obliged to pay the agreed or usual business price less the saved expenditure of the guest (20 %).
This also applies to holiday flats. - In order to avoid losses, the landlord is required in good faith to rent to other guests any reserved rooms which have not been taken.
- As per point 4 the guest has to pay the calculated amount for the contract period if the room has not been rented otherwise.
